1. DEFINITIONS

In these terms and conditions, the following expressions shall have the following meanings unless the context requires otherwise:

• "You" and "your" means the person, the partnership or company ordering the goods under these terms and conditions.
• "Us" and "We" means PURPLESTAIN.COM.
• "Delivery" shall mean completion of goods at the location directed by you to us.
• "The Goods" means the goods, materials, parts or other things to be supplied by us to you.
• "The Price" means the sum stated on the order of all trade, credit card and other discounts and exclusive of value added tax.
• "Working day" means every day of a calendar year apart from weekends and statutory and public holidays.

2. THE CONTRACT BETWEEN US

Once World Pay has approved payment, PURPLESTAIN.COM will confirm that your order has been accepted by sending an e-mail to you at the address you provide in your order form. PURPLESTAIN.COM's acceptance of your order brings into existence a legally binding contract between us.

3. AVAILABILITY OF GOODS YOU ORDER

We dispatch most orders with 3 days however in the event PURPLESTAIN.COM are out of stock of a particular product, we will notify you by email and the product/s will be placed on back order to be shipped to you at the earliest convenience.

As a large number of products are imported this can sometimes take longer, however Any items placed on back order are normally dispatched in under 14 days. If you choose to cancel your order money will be reimbursed to you within 30 days. PURPLESTAIN.COM will not be obliged to offer any additional compensation for disappointment suffered.

4. PRICE

The prices payable for goods that you order is set out in our Web site.
You will be required to pay extra for orders you wish to be delivered by alternative means.

5. WITHDRAWAL BY YOU FROM THE CONTRACT

You may withdraw your order for goods at any time up to the end of the fifth working day after you make your order even if you have then already received the goods. If you are returning the goods you must email us at info@purplestain.com notifying us of any reason of withdrawal, before returning your goods. The only circumstances in which you cannot withdraw your order are where you have taken the goods you have ordered (or the ones in relation to which you want to withdraw) out of the sealed package in which they were delivered.
To withdraw your order you must notify PURPLESTAIN.COM by e-mail or in writing at the address set out at the bottom of these terms.
If you have received the goods before you withdraw your order then, unless you have lost your right to withdraw because you have taken the goods out of their sealed package, you must send them back to PURPLESTAIN.COM at your own cost and risk. If you withdraw your order but PURPLESTAIN.COM has already processed the goods for delivery, you must not unpack the goods when they are received by you and you must send the goods back to PURPLESTAIN.COM provided at the bottom of this page.
Once you have notified PURPLESTAIN.COM that you are withdrawing your order, any sum debited to PURPLESTAIN.COM from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by PURPLESTAIN.COM in the condition they were in delivered to you.
No returns for credit can be accepted unless PURPLESTAIN.COM has supplied incorrectly, or the goods have been damaged.
DAMAGED GOODS should be returned to PURPLESTAIN.COM and you will be sent a replacement.
Authorisation to return for credit must be obtained prior to returning goods.
Always quote invoice number on correspondence or with returns.

6. DELIVERY OF GOODS TO YOU

PURPLESTAIN.COM will deliver the goods ordered by you to the address you give PURPLESTAIN.COM for delivery at the time you make your order.
Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of you’re order.

7. LIABILITY

If the goods PURPLESTAIN.COM delivery are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, PURPLESTAIN.COM shall have no liability to you unless you notify PURPLESTAIN.COM in writing at the PURPLESTAIN.COM contact address stating the problem within 10 working days of the delivery of goods in question.
If you do not receive goods ordered by you within 30 days of the date on which you ordered them, PURPLESTAIN.COM shall have no liability to you unless you notify
PURPLESTAIN.COM in writing at the PURPLESTAIN.COM contact address of the problem within 40 days of the date on which you ordered the goods.
If you notify a problem to PURPLESTAIN.COM under this condition, PURPLESTAIN.COM only obligation will be, at its option:

1. To make good any shortage or non-delivery if it is at fault
2. To replace any goods that are damaged or defective once blame has been attributed.
3. o refund to you the amount paid by you for the goods in question in whatever way PURPLESTAIN.COM chooses.

PURPLESTAIN.COM will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to PURPLESTAIN.COM under this condition and PURPLESTAIN.COM shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under paragraph [c] above.
Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit PURPLESTAIN.COM liability to you for any death or personal injury resulting from its negligence.
PURPLESTAIN.COM shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

8. GOVERNING LAW

The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes between us.

9. ENTIRE AGREEMENT

These terms and conditions, together with the current PURPLESTAIN.COM prices, delivery details and PURPLESTAIN.COM details, set out the whole agreement relating to the supply of the goods to you by PURPLESTAIN.COM.
No variation to these terms shall be binding unless agreed in writing between the authorised representatives of PURPLESTAIN.COM and the customer.
